{"id":489,"date":"2014-12-04T04:00:36","date_gmt":"2014-12-04T04:00:36","guid":{"rendered":"http:\/\/www.emily-esque.com\/wp\/?p=489"},"modified":"2015-02-12T20:38:10","modified_gmt":"2015-02-12T20:38:10","slug":"new-department-of-labor-lgbt-rule-published-labor-lacks-answers-on-transgender-exclusions-in-health-insurance","status":"publish","type":"post","link":"http:\/\/www.emily-esque.com\/wp\/?p=489","title":{"rendered":"New Department of Labor &#8220;LGBT&#8221; Rule Published; Labor Lacks Answers on Transgender Exclusions in Health Insurance"},"content":{"rendered":"<p>Today, the <a href=\"http:\/\/blog.dol.gov\/2014\/12\/03\/equality-fairness-and-opportunity\/\">Department of Labor announced publication of its final rule<\/a> implementing <a href=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2014-07-23\/pdf\/2014-17522.pdf\">Executive Order 13,672 of July 21, 2014<\/a>, which required the Department to publish rules prohibiting Federal contractors from discriminating on the basis of sexual orientation or gender identity (<a href=\"http:\/\/www.dol.gov\/opa\/media\/press\/ofccp\/OFCCP20141942.htm\">an additional press release is available<\/a>). \u00a0<a href=\"https:\/\/federalregister.gov\/a\/2014-28501\">The rule<\/a>\u00a0further reinforces existing law and supplements the EEOC&#8217;s decision in <a href=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/macy-v-holder.pdf\">Macy v. Holder<\/a>: \u00a0discrimination on the basis of sexual orientation and gender identity is illegal.<\/p>\n<p>Since the rule failed to address health insurance, I called the Department of Labor&#8217;s Office of Federal Contract Compliance Programs. \u00a0After a transfer, I wanted to make sure I was speaking with the right people.<\/p>\n<audio class=\"wp-audio-shortcode\" id=\"audio-489-1\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-DOL-OFCCP-Policy-Division-Were-Basically-It.mp3?_=1\" \/><a href=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-DOL-OFCCP-Policy-Division-Were-Basically-It.mp3\">http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-DOL-OFCCP-Policy-Division-Were-Basically-It.mp3<\/a><\/audio>\n<blockquote><p>Emily: \u00a0I&#8217;m not actually sure which department I&#8217;m speaking with.<\/p>\n<p>OFCCP: I&#8217;m in the national office at OFCCP, in the policy division. \u00a0We&#8217;re pretty much it.<\/p><\/blockquote>\n<p>I asked\u00a0the OFCCP compliance officer:<\/p>\n<audio class=\"wp-audio-shortcode\" id=\"audio-489-2\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-Asking-The-Actual-Question.mp3?_=2\" \/><a href=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-Asking-The-Actual-Question.mp3\">http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-Asking-The-Actual-Question.mp3<\/a><\/audio>\n<blockquote><p>Emily: \u00a0If a insurance provider is, or rather, if an employer is providing insurance that discriminates on one of the protected bases, would that be prohibited by this regulation.<\/p><\/blockquote>\n<p>[some conversation ensues about who the proper person to answer that question would be; the OFCCP compliance officer eventually puts me on hold to see if there is a prepared answer]:<\/p>\n<audio class=\"wp-audio-shortcode\" id=\"audio-489-3\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-DOL-Has-No-Legal-Opinion-on-Transgender-Health-Exclusions.mp3?_=3\" \/><a href=\"http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-DOL-Has-No-Legal-Opinion-on-Transgender-Health-Exclusions.mp3\">http:\/\/www.emily-esque.com\/wp\/wp-content\/uploads\/2014\/12\/2014-12-03-DOL-Has-No-Legal-Opinion-on-Transgender-Health-Exclusions.mp3<\/a><\/audio>\n<blockquote><p>OFCCP: \u00a0Emily?<\/p>\n<p>Emily: \u00a0Yes.<\/p>\n<p>OFCCP: \u00a0OK, I&#8217;m so sorry to keep you on hold for so long.<\/p>\n<p>Emily: \u00a0Totally understandable.<\/p>\n<p>OFCCP: \u00a0But I wanted to clarify, you know, to make sure, and basically the only thing we can say\u00a0<strong>at the\u00a0moment<\/strong> that it applies the same way our other rules apply in terms of how, essentially, terms and conditions of employment apply.<\/p>\n<p>Emily: \u00a0Right.<\/p>\n<p>OFCCP: \u00a0And that includes benefits such as health insurance.<\/p>\n<p>Emily: \u00a0Right. \u00a0But the Department of Labor is not willing at this time to state that it is legal, or&#8230; hormone replacement therapy, it doesn&#8217;t look like that&#8217;s going to be covered either.
